Introduction
These conditions of sale (hereinafter only "General Conditions") govern the sale of products marketed by www.seccodocg.it. All contracts for the purchase of products concluded, through the website www.seccodocg.it and according to the procedures indicated therein, between the seller and the Customer, will be governed by these General Conditions.
All published prices are inclusive of VAT.

 


Acceptance of the conditions of sale
1.
The contract stipulated between Specialitaly and the Customer must be considered concluded with the acceptance, even if only partial, of the order by Specialitaly, which reserves the right, at its sole discretion, to accept the order. Acceptance is considered tacit, unless otherwise communicated to the Customer in any way. By placing an order in the various ways provided, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the general and payment conditions transcribed below.

2. If the Customer is a final consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity), once the online purchase procedure has been completed, he will print or save an electronic copy and, in any case, keep these general conditions of sale, in compliance with the provisions of articles 3 and 4 of Legislative Decree n. 185/1999 on distance selling.

3. Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance, even partial, of an order.

How to purchase
1.
The Customer can only purchase the products present in the Specialitaly srl electronic catalog at the time of placing the order and which can be viewed at http://www.seccodocg.it, as described in the relevant information sheets. The technical information included in the site http://www.seccodocg.it faithfully reproduce those of the goods included in the catalog. Specialitaly srl, therefore, reserves the right to modify the technical information of the products, without the need for any prior notice. It is understood that the image accompanying the description of a product may not be perfectly representative of its characteristics, and may differ in color, size, accessory products shown in the figure. All purchasing support information (Glossary, Buying Guide, etc ...) are intended as simple generic information material, not referable to the real characteristics of each individual product.
Specialitaly srl guarantees the conformity of the accessories sold on the site with the relevant EC Directives.

2. Correct receipt of the order is confirmed by Specialitaly through an e-mail reply, sent to the e-mail address supplied by the Customer. This confirmation message will contain the date and time of receipt of the order and a 'Customer Order Number', to be used in any further communication with Specialitaly srl. The message re-proposes all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document. The Customer can also check the status of his order by accessing the web area dedicated to him under the item "Order status".

3. In case of non-acceptance of the order, Specialitaly srl undertakes to promptly notify the Customer.

4. All prices on the site are to be intended as prices to the public and, therefore, inclusive of VAT. Specialitaly srl reserves the right to change prices at any time, without notice. In the event that an incorrect and / or clearly derisory price is published, for any reason (error in our systems, human error, etc.), the order will be canceled, even in the case of initial validation.

5. On the site http://www.seccodocg.it you can see the product quantities available at the time of the order. Since the simultaneous access of many users-customers and the simultaneous possibility of "online" orders modify the availability of the product, Specialitaly srl does not guarantee the certainty of assignment of the ordered goods.

6. On certain products, subject to price promotions, Specialitaly srl reserves the right to accept orders by reducing their quantities, subject to communication and acceptance by the Customer, failing which the order will be considered canceled.

Terms of payment

Advance Bank Transfer
In case of payment by bank transfer in advance, the sending of the order takes place only upon the actual crediting of the c / c of Specialitaly srl, which must take place within 5 working days from the date of acceptance of the order, after which the order is considered automatically canceled.
The purpose of the bank transfer must include the beneficiary (Specialitaly srl) and the order ID (year, type and order number), which is issued in the order confirmation email.

Credit card
In cases of purchase of goods with credit card payment methods, at the same time as the online transaction is concluded, the reference bank authorizes only the commitment of the amount relating to the purchase made.
The amount relating to the delivered goods is charged to the Customer's credit card at the time of the actual fulfillment of the ordered goods.
The credit cards accepted are all those that rely on the Visa, Mastercard circuits.

 

CAUTION:

In case of cancellation of the order, both by the Customer and in case of rejection of Specialitaly srl, the same will simultaneously request the cancellation of the transaction and the release of the committed amount. . The cancellation of the order is possible until the moment in which the same is not yet in preparation in stock. The status of the order is clearly visible in the "Order status" area and can no longer be canceled if the indication "Order in progress" appears. The release times, for some types of cards, depend exclusively on the banking system and can go up to their natural expiry date (24th day from the date of authorization). Once the cancellation of the transaction has been requested, in no case Specialitaly srl can be held responsible for any damages, direct or indirect, caused by delay in the failure to release the amount committed by the banking system.

In the event that the Customer's order is still open after the 23rd day from the forwarding date, Specialitaly srl will in any case charge the Customer's credit card for the amount due, even if in advance of the material delivery of the goods, in order to avoid the authorization expiration of the transaction (24 days).

Specialitaly srl reserves the right to request additional information from the customer (eg landline telephone number) or to send copies of documents proving ownership of the card used. In the absence of the required documentation, Specialitaly srl reserves the right not to accept the order.

At no time during the purchase procedure Specialitaly srl is able to know the information relating to the buyer's credit card, as they are typed directly on the website of the bank that manages the transaction (with very high security systems); since there is no data transmission, there is no possibility that these data are intercepted. No Specialitaly srl computer archive contains or keeps such data. In no case Specialitaly can therefore be held responsible for any fraudulent and improper use of credit cards by third parties, upon payment of products purchased on www.seccodocg.it

Prepaid credit card
In case of purchase with a prepaid credit card, the customer enters the identification numbers of the card; at the same time as the online transaction is concluded, the reference bank authorizes only the commitment relating to the purchase made. The amount relating to the delivered goods is charged to the Customer's credit card at the time of the actual fulfillment of the ordered goods.

PayPal
In case of purchase through the PayPal payment method, at the end of the order the Customer is directed to the PayPal login page.
The amount relating to the order is debited from the PayPal account at the time of order acquisition.
In case of cancellation of the order, both by the Customer and in case of rejection by Specialitaly srl, the amount will be refunded to the customer's PayPal account.

The cancellation of the order is possible until the moment in which the same is not yet in preparation in stock. The status of the order is clearly visible in the "Order status" area and can no longer be canceled if the indication "Order in progress" appears.

Once the cancellation of the transaction has been requested, in no case Specialitaly srl can be held responsible for any damages, direct or indirect, caused by delay in the failure to release the amount committed by PayPal. At no time during the purchase procedure Specialitaly srl is able to know the Customer's financial information. Since there is no data transmission, there is no possibility that this data will be intercepted. No Specialitaly srl computer archive contains or keeps such data. For each transaction made with the PayPal account, the Customer will receive a confirmation email from PayPal.

Transaction security
Online transactions with Credit card are carried out directly on the Bank's website, through a Secure Server which adopts the SSL (Secure Socket Layer) protection system. This protocol, Verisign certified, allows you to communicate in a manner designed to avoid the interception, modification or falsification of information. Specialitaly srl is not aware of the credit card data used by your customers.

Delivery methods
Specialitaly srl can only accept orders for delivery in the territory of the Italian state.

For every order placed on www.seccodocg.it, Specialitaly srl will issue an invoice for the material shipped. For the issue of the invoice, the information provided by the Customer at the time of the order is valid. No change in the invoice will be possible after its issue.

Shipping costs are charged to the customer and are explicitly highlighted at the time the order is placed. The payment of the goods by the Customer will be made using the method chosen when placing the order. No additional expenses or commission are due to Specialitaly srl.

The delivery of the ordered goods is intended to the home floor up to a weight of 30Kg.

The delivery times of the ordered goods are purely indicative and are published in the appropriate table under the heading "indicative delivery times"; they may undergo variations due to force majeure or due to traffic and road conditions in general or by act of the Authority. The standard delivery, unless otherwise agreed in writing between the parties, will take place at the following times: from 9.00 to 13.00; from 2.00 pm to 6.00 pm, every day, except holidays, from Monday to Friday.

No responsibility can be attributed to Specialitaly srl in case of delay in the fulfillment of the order or in the delivery of the ordered goods.

Upon delivery of the goods by the courier, the Customer is required to check:
- that the number of packages delivered corresponds to what is indicated on the invoice;
- that the packaging is intact, not damaged or wet or, in any case, altered;

Any external damage or the mismatch in the number of packages or indications, must be immediately reported to the courier making the delivery, adding the wording "withdrawal with reserve" on the appropriate accompanying document and confirmed within 8 days by registered mail with receipt of return to the courier, whose address is specified on the accompanying document. In the specific case of a damaged package, write "withdrawal with reserve because the package is damaged". It is also required to open an anomaly file at Specialitaly srl, filling in what is present under the button in the "Order status" area.
Once the courier's document has been signed, the Customer will not be able to make any objection about the external characteristics of what has been delivered.
Even if the packaging is intact, the goods must be checked within eight days of receipt. Any damage or hidden anomalies must be reported in writing by registered mail with return receipt to the courier whose address is specified on the accompanying document.
It is also required to open an anomaly file at Specialitaly srl, filling in what is present under the button in the "Order status" area.
Any report beyond the aforementioned terms will not be taken into consideration.
 For each declaration, the Customer assumes full responsibility for what is declared.

Delivery by express courier
In the case of delivery by express courier, the delivery service to the home floor is included for products weighing less than 30kg.
Standard delivery will take place at the following times: from 9.00 to 13.00; from 2.00 pm to 6.00 pm, every day, except holidays, from Monday to Friday.
The courier makes the first delivery without notice. In case of absence of the Customer, the courier leaves a notice and retries the delivery in the following 24 hours; in case of further absence, a notice is left again and the customer is contacted by the courier for the third attempt. If this is not successful, the Customer will be contacted by the Customer Service of Specialitaly srl with which he will define the delivery details. If even the fourth attempt is not successful, the goods will be returned to Specialitaly srl, with consequent cancellation of the order and nothing will be due to the Customer.

 

Processing and delivery times

1. Order processing times
With "order fulfillment times" we mean the time interval that passes from the receipt of the order to the delivery of the product to the courier.
All orders, containing products available in stock, for which payment confirmation has been received by 12.00 on a working day, are entrusted to the courier within the following 48 hours

2. Courier delivery times
The table below shows the approximate delivery times expressed in hours, in the case of delivery by express courier from the moment the courier takes charge of the shipment (collection of the shipment at our Logistics Center by the courier).

Specialitaly srl reserves the right to vary these conditions without notice as the conditions of use vary and the contracts with the various carriers vary.

Right of withdrawal
1.
Pursuant to art. 59 LEGISLATIVE DECREE 21 February 2014, n. 21 the right of withdrawal of those foodstuffs which, by their nature, deteriorate completely after opening, is applicable only in the event that such goods are returned in perfect integrity of the food package itself. In the specific case of wines, therefore, the bottle cannot be opened and returned together with its contents; while the packaging containing the bottle can be opened and the bottle returned if kept intact. Wines, grappas, spirits, food products sold by Specialitaly srl are therefore subject to this rule.

  1. For other products, other than wines, grappas, spirits, food products, sold by Specialitaly srl, if the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not carry out 'purchase by indicating in the order form a VAT number reference to Specialitaly srl), it is possible to withdraw from the purchase contract for any reason within 14 days of receipt of the goods.
  2. To exercise this right, it is sufficient for the Customer to send an explicit declaration, also by email, of the intention to exercise the right of withdrawal. Specialitaly srl will send the customer by e-mail a paper form which must be printed and which contains the authorization number which must be attached to the outside of the casing in which the product will be physically placed and sent to Specialitaly srl, without undue delay, within 14 working days from the withdrawal authorization.
  3. The customer who withdraws, for products covered by the right of withdrawal, will be reimbursed for the payments made, including delivery costs (with the exception of additional costs deriving from the possible choice of a type of delivery other than the least expensive type of standard delivery offered) , without undue delay and in any case no later than 14 days from when Specialitaly srl receives the decision to withdraw. These refunds will be made using the same payment method used for the initial transaction, unless the customer requests a refund on a different payment method. In this case, any additional costs deriving from the different payment method chosen will be charged to the customer. The reimbursement may be suspended until receipt of the goods or until the customer demonstrates that he has returned the goods. For the refund to be made by bank transfer, the customer must also indicate the bank details necessary to return the sums paid.
  4. The customer is only responsible for the decrease in the value of the goods resulting from handling other than that necessary to establish the nature, characteristics and functioning of the goods.

Guarantees

All products marketed by Specialitaly srl are covered by the manufacturer's conventional warranty pursuant to Legislative Decree no. 24/02. To use the warranty, the Customer must keep the invoice (or the DDT) that he will receive together with the purchased goods. The Customer can always download the invoices relating to his purchases from the website www.seccodocg.it by accessing the reserved area.

  1. Legal guarantee of conformity
    In the presence of a lack of conformity, the consumer has the right, at his choice, to the repair or replacement of the defective goods by the seller, without charge, unless the remedy requested is impossible or excessively expensive compared to the other. If replacement or repair is not possible, the consumer is still entitled to a price reduction or to have a sum back, commensurate with the value of the goods, against the return of the defective product to the seller.
  2. Duration of the legal guarantee
    The legal guarantee lasts two years from the delivery of the goods and must be asserted by the consumer within two months from the discovery of the defect: it is therefore necessary to always keep the proof of purchase (receipt or invoice).
  3. Seller's obligations
    In the event of a dispute, Specialitaly srl undertakes to:
  • take delivery of the defective product to verify whether or not the malfunction is due to a lack of conformity. In particular: (i) for defects that occur in the first six months from the date of delivery of the product, verification is always charged to the seller as it is assumed that they existed at the time of delivery; (ii) subsequently, in the sole case in which the malfunction does not depend on a lack of conformity, the consumer can be asked to reimburse the cost - reasonable and previously indicated - that the seller has incurred for the verification;
  • found the lack of conformity, repair or replace the goods within a reasonable time from the request and without charging the consumer.
